Director, Global Ethics & Compliance

Job Summary

The Global Director, Ethics and Compliance, takes a leadership role in working with the Chief Compliance Officer, to implement and maintain an effective Global corporate compliance program, including ethics and compliance risk assessments, mitigation strategies, training programs, auditing and monitoring activities and workplace compliance investigations.

Additionally, leads the business ethics and compliance committee(s) for Canada, providing compliance oversight for the region, and making necessary modifications to the global business ethics and compliance program to meet regional needs.  Assists the regional Compliance Officers for LATAM, US, Middle East and India in the implementation of the global program.

Additionally takes a lead role in the management of the global data privacy program including leading global risk assessments, policy development, third party due diligence activities, training, monitoring and auditing.

Takes a lead role in the global business ethics and compliance ESG activities, including customer ethical sourcing audits and due diligence requests, and ESG program deliverables.

Takes a lead role in the oversight of investigations related to quality and reported through the ethics and compliance speak up channels.

Job Responsibilities

• Identify, assess, and prioritize ethics and compliance related organizational risks for the Canadian operations. In conjunction with business leaders in the Canadian operations, make recommendations and implement the GBEC operational plan in Canada, to effectively reduce identified compliance risks for the Canadian operations.
• Collaborate with senior leaders and colleagues to establish regional and global internal controls, including policies and procedures, to ensure compliance with the Apotex Code of Conduct and Business Ethics (“Code of Conduct”), and applicable corporate policies and laws.
• Provide effective compliance training to all Canada employees and other internal stakeholders.
• Participate in cross functional teams, such as the Ethics Liaison Network, and software implementation projects to enhance the performance of the GBEC program.
• Participate in GBEC investigations of alleged misconduct or other compliance-related matters in Canada or ROW, as applicable. Takes a lead role in the oversight of investigations related to quality and reported through the ethics and compliance speak up channels.
• Chair and coordinate the Canada commercial Business Ethics and Compliance Committee (BECC).
• Leads the lobbying disclosure program for Canada, managing lobbying system and timely disclosures as per provincial and federal requirements.
• Provide routine reports to the VP, CCO and Canada BECC on compliance issues, activities, data trends and programs for areas of responsibility. Collaborate with ethics and compliance officers in other regions, leading global GBEC initiatives, where required.
• Develop and implement applicable GBEC-related corporate policies and procedures for the Canadian and/or global operations. Provide subject matter expertise to leaders and employees on the interpretation of such documents.
• Take a lead role in the management of the global data privacy program including leading global risk assessments, policy development, third party due diligence activities, training, monitoring, and auditing.

• Conduct regular GBEC auditing and monitoring activities to strengthen internal controls to prevent and detect significant instances or patterns of illegal, unethical, or improper conduct by employees and/or third parties working with the organization.
• Participate and lead performance conversations with employees, including monthly one on ones, to connect on performance.

Job Requirements

• Education
  • A university degree is required (scientific, business or legal).
    
    
• Knowledge, Skills, and Abilities
  • Strong knowledge of compliance laws and regulations and industry guidance affecting the pharmaceutical industry in Canada.
  • Excellent interpersonal, communication and written skills, proven ability to work with a wide range of stakeholders. French language proficiency is desirable but not mandatory.
  • In-depth knowledge in privacy regulations and standards as applicable to the pharmaceutical industry.
  • Working knowledge of corporate compliance program systems, such as hotlines.

• Experience
  • 10+ years’ experience in the pharmaceutical, medical device or health care industries, working at one or more multi-national companies with global operations. Canadian experience and experience with pharmaceutical quality systems and regualtions is preferable.
  • Significant experience with laws, regulations and industry guidance that affect the pharmaceutical industry including, but not limited to, OIG, anti-trust laws, healthcare standard operating procedures, competition law.
  • Significant experience in dealing in compliance investigations, or certification as a Certified Compliance and Ethics Professional (CCEP), preferred.
